In the ongoing discussion about Mediation Confidentiality the attached document is a Staff Memorandum published May 28, 2015, by the CALIFORNIA LAW REVISION COMMISSION. The opening paragraph states:
In this study of the relationship between mediation confidentiality and attorney malpractice and other misconduct, the Legislature specifically directed the Commission1 to consider certain matters, including “scholarly commentary.” Consistent with that directive, previous staff memoranda contain numerous references to scholarly commentary (especially the memorandum on empirical data). This memorandum continues the Commission’s background research, focusing specifically on scholarly commentary.
