Mediation Confidentiality and
Classroom 7 (Downstairs)
Jack Goetz and Barbara Brown will update the membership on the work of SCMA’s Ad Hoc Committee on Voluntary Mediator Certification.
Mediation Confidentiality is being reconsidered in California. The California Law Revision Commission has tentatively decided to recommend that the law be changed. Under the recommendation, confidential information and private matters revealed in mediations may be subject to disclosure — possibly in open court — if one of the parties brings a malpractice action against his or her lawyer.
Lee Blackman and Phyllis Pollack will update the membership on the most recent meetings of the California Law Revision Commission (“CLRC”) concerning possible revisions to the Evidence Code with respect to mediation confidentiality. You will learn what the CLRC is likely to recommend to the California Legislature and you will have a chance to share your views.
We will be looking for consensus as to a more formal position to be presented by SCMA on behalf our members to Law Revision Commission at its upcoming meeting in Sacramento on April 14th.
3.0 hours of CLE, including 1.5 hours of specialty (Ethics).
Parking: Our parking reservation is on the USC Campus in Parking Structure X (PSX). PSX is located at Gate 3 at the intersection of USC McCarthy Way and Figueroa, half a block north of Exposition Blvd., on the east side of the campus. Enter at Gate 3, drive up to the booth, identify yourself to the attendant as someone attending the law school event, give the RSVP ID number (114839) to the attendant, pay the $12 parking fee (typically in cash) and will give you a permit. After you receive your pass, park in the structure.
Directions: To get to the Law School from the parking garage, exit the stairway on the campus (rather than the street) side of the garage. Then turn left and start walking towards a brick building that says “Ralph and Goldy Lewis Hall” inscribed in large letters. Once you get to that building, you are very close. Walk around the right side of building, and then turn left on the pathway leading to Town & Gown (in aqua on the attached map). The Law School is a four story grey building just past Town & Gown when heading toward Exposition Blvd. Enter the building at ttthe north entrance. You will be in the central lobby of the Law School.
